Importer Exporter Code

Every person who is involved in the business of Import-Export of Goods or Services is required to obtain Import Export (IE) Code from the DGFT. The full form of the DGFT is Directorate General of Foreign Trade which comes under the Ministry of Commerce and Industries, Government of India. The application for Import Export code should be filed online to the Directorate General of Foreign Trade along with the necessary documents. Now a days, the Import Export Code registration certificate is obtained within 1 days i.e. same day of the submission of the application.

Validity of IE Code

The Import Export Code registration is permanent registration and it is valid for lifetime. Therefore, there will be no problems for updating, filing and renewal of Import Export Code (IE Code) registration. The IE Code shall remain valid until the business exists or the registration is revoked or surrendered. Further, unlike tax registrations like GST registration or PF registration, the importer or exporter is not required to file any filings or returns etc. with the department.

The Import Export Code registration is one-time and requires no additional compliance, it is recommended for all companies and LLPs to obtain IE code after incorporation which are involved in the business of import or export of goods or services.

Import Export Code Exemption

The IE Code is required for importing any type of goods by a business in India. However, the following persons are exempted from obtaining Import Export Code:

  • Importer and export by central Government or agencies or undertakings for defence purpose or other specified lists under Foreign Trade (exemption from the application of Rules in certain cases) Order, 1993.
  • Import or Export of Goods for personal use.

Applying for Import Export Code

New Procedure for online IEC application/modification has been introduced vide Trade Notice No 23/2018-19 New Delhi, Dated the 8 th August,2018. As per the latest rules, notification and process issued by the department, an IE Code can be applied and obtained online on the web portal of DGFT.

Documents Required for Import Export Code Application

The following are the documents required for making an IE Code application in India.

(i) Mandatory Documents to be uploaded for new IEC
(a)   Bank Certificate / Pre-printed Cancelled Cheque Required  *
(b)  Address Proof of the firm Required  *
 Any of the Following Documents: Sale deed | Rent agreement | Lease Deed | Electricity bill | Telephone Land line bill | Mobile Postpaid bill | MOU | Partnership Deed
 Other acceptable documents(for Proprietorship only): Aadhar Card | Passport | Voter Id
In case the address proof is not in the name of the applicant firm, a No Objection Certificate(NOC) by the firm premises owner in favour of the firm along with the address proof is to be submitted as a single PDF document
(ii) Digital Signature Certificate Now Not Required
Copy of PAN Card Now Not Required
Photograph Now Not Required

Import Export Code Issuance

Once the online application is submitted, along with appropriate fees and requisite documents, Import-Export Code Certificate will be auto-generated. An automated email and sms is sent on the allotment of IEC. The IE Code certificate will only be provided digitally and can be downloaded from the link provided. An e-IEC holder needs to update his profile immediately after issuance of e-IEC. Further, in case of any change to the details mentioned in the IEC or in any other case, the profile needs to be updated.

Though the import-export code is auto-generated, the Regional Authority would conduct post-verification of the online IEC as per the guidelines. In case there is any wrong/incomplete information being furnished, the applicant would be liable for penal/criminal action and in such case, IEC would be either suspended or cancelled.

RCMC Registration

Persons having import-export code can apply for and obtain RCMC registration. Registration-Cum-Membership Certificate (RCMC) is a certificate that validates an exporter dealing with products registered with an agency/organisation that are authorised by the Indian Government. The certificate is issued for five years by the Export Promotional Councils or commodity board in India. An exporter desiring to obtain an RCMC has to declare his mainstream business in the application. This application would be submitted to the Export Promotion Council/ Commodity Board relating to that line of business.
